How to Avoid Getting Your House Foreclosed On

 

Don’t give up, there is still hope

You’ve worked so hard to buy your home, and it is one of your biggest investments. You are proud of it, and it is a source of comfort and peace for you. But if you fall on hard times, and you are unable to keep up with your monthly mortgage payments, you may lose your home to foreclosure.

Before such a drastic thing happens, what can you do to avoid foreclosure?

If you are at the end of your rope financially, don’t give up. Consider your other options. Just think of how much more difficult it will be to get a new home when you credit rating is affected. It will definitely be affected if you let your lender foreclose your home.

Foreclosure alternatives

If your monthly mortgages are piling up, here are some options for you to choose from:

  • Consider a short sale.  A foreclosure is a big deal to lenders because they will lose money, so when you are unable to make payments, the lender usually takes it to court. And if you happen to have a second mortgage or other loans secured by the home, you stand the chance of not just losing your home but your money as well.

When there is no way for you come up with the monthly mortgage, a short sale is a better option. Doing a short sale is beneficial for both you and the lender, and a far better alternative than foreclosure.  

A short sale is when you sell the home for less than the outstanding mortgage on it, with the signed approval of the lender of course.  In a short sale, your REALTOR® will work with the mortgage lender to get a deficiency waiver so that the balance can be forgiven. Your REALTOR® will also work with any  other lenders so that their lien or claim can be removed.

One advantage of short sale over foreclosure is there will be no foreclosure stigma attached to your credit rating. Foreclosures appear on your credit report for seven years, and make it difficult to buy a new home, even if you have saved enough for a down payment and have already gotten a good job.

A short sale also appears on your credit record and lowers your credit score, but you will have get a shorter waiting period before you quality for a Fannie Mae or Fred Mac loan.

Another advantage of short sale is it allows a fresh start. With a foreclosure, only your mortgage payments are taken care of, but with a short sale, all your debts are negotiated by the real estate agent. The selling process will proceed like a normal real estate transaction, so if you chose not to tell your neighbors, they won’t even know the real reason why you’re selling your home.

  • Talk to your lender about a loan modification. When you realize you are behind on your payments and you are not able to come up with a full amount to cover the outstanding monthly mortgage, you need to call your lender.  Most lenders would rather negotiate a compromise which will help you catch up with your payments rather than foreclose on your home. A loan modification can give you a more affordable monthly  mortgage payment, it’s less damaging to your credit rating, and best of all, lets you keep your home.
  • Seek assistance from the government. There are several government programs to help you refinance your loan.  You might consider getting help from the Making Home Affordable (MHA), or the Home Affordable Modification Program (HAMP).  These programs seek to provide qualified homeowners a chance to reduce their monthly mortgage payment to a more affordable price.
  • Opt for a mortgage forbearance agreement.  If you are having difficulty with your monthly payments because of a temporary issue like unemployment or health problems, another good option is talking to your lender about a forbearance agreement.

A mortgage forbearance agreement is a temporary solution for borrowers.  In this agreement, the lender agrees to reduce or suspend payments for a specific time frame, and not to initiate foreclosure. You as the borrower, promise to pay an additional amount to cover the monthly mortgage, including the principal, interest, taxes and insurance, once the agreed upon time period has elapsed.

Don’t allow your hard work to go to the lender. There are many ways you can avoid getting your home foreclosed on.

Buying a home in a seller’s market can be a bit more challenging. According to Nancy, a buyer has to move fast and be prepared to write a strong, flexible offer. Expect that there will be multiple offers, cash offers, and bidding wars.

In this type of market, there are more buyers than there are homes available for sale. There will be fierce competition. So, how in the world do you set yourself apart from the rest of the buyers?

Colleen: If you're thinking about buying a home soon, it's time to get your game on.

Eugene: It's a seller's market and that means there’s some tough competition for buyers who are interested in the same property.

Colleen: Yeah. Nancy Braun with Showcase Realty can help. So Nancy, it really is a seller's market. What does that mean for buyers?

Nancy: It's very challenging for some buyers especially anything under $500,000. There's such a demand. So the buyers have to be very, very quick to look at homes and be prepared to write an offer right when they're at the house. 

Colleen: Because a lot of times multiple buyers will be putting an offer on the same home.

Nancy: That's right. Any of the best houses especially some of the homes that are close in into the Charlotte region are going to sell very, very quickly and there's gonna be multiple offers.

Colleen: Now, you really help your clients, your buyers stand out. Talk about how you do that.

Nancy: So one of the things I do right when I'm at the house, showing the house, I call the agent directly and then I ask the agent, “Well, tell me what the sellers are looking for?” It’s not always price. It could be timing. It could be that they love that stove. It could be that they want time to move after closing and rent back from the buyer. And I want to know those criteria because those might appeal to that seller more than just writing a traditional offer. 

Colleen: So you like to put together a good claim - that solid offer. Talk more about what that looks like.

Nancy: So, yes. We always use that term, “clean” but it includes not asking for a lot of things. So if you might ask for that patio furniture in the backyard, well that might be his grandmother's, you know. You don't know what it's important to that seller. So that phone call really kind of narrows down what are permissible for me to include in the offer and what isn't. But as simple as how many days for due diligence might alter my offer to take second place over another offer. So I want to have a short period of time for us to do our investigation as far as making sure that they know that we can move forward. I want to make sure that we can put up as much due diligence fee and earnest money deposit as my clients can afford.If they can do cash, cash always wins. Or if they can't do cash, then I want an actual approval letter from the lender. I don't want some weak pre-qualification letter. I want a letter actually written specifically for this property from my lender that the seller can look at and go, “Wow! This is a really solid buyer.” 

Colleen: So you actually have the buyer write a letter about why someone likes the house so much, maybe even include a family photo?

Nancy: Absolutely. Absolutely. That really makes a big difference. I recently sold my parents house and I can tell you that the first buyer that came through wrote me one of those letters. And I could feel, you know, this is a home I grew up in. My mom would love this home. It really meant a lot to me. So, I know that that personal letter from a buyer is critical in a multiple offer situation especially, if they're going to be owner-occupants. I was at an appointment last night and they were talking about them selling another home that they had and they were disappointed that the For Rent sign went up in the yard right after they sold it. And they internalized and personalized the home. So those letters - we in the industry call them love letters - really could be effective. So when I sit down and meet with a buyer, initially, I'll say, start writing the letter. We'll eventually get the particulars about the home that might really be relevant to this specific home we find but you can start getting pictures of your dogs, your kids, and reasons why you moved to Charlotte or some hot buttons that someone might, you know, be interested in hearing. 

Colleen: And quickly, I should mention too, you don't just do this via email. You put it all together in a nice little packet to give to the other agent.

Nancy: Yes, right. So traditionally most people just email the offer to purchase. Whereas, our multiple offer package could be really quite thick and it's going to have letters from the lender and letters from the buyers. It's going to have the specific disclosures included. It's going to have more documents documenting that they have the earnest money copies of their checks that they're submitting. It's a very, very thorough package including a table of contents. So always I think of seller includes if it's a husband and wife you've got one that's more detailed, number focused. One's more emotionally focused. So obviously the letters are more emotionally driven but then the table of contents and all the documentation appeals to the other partner who's going to be more detailed.

The list analyses the highest concentrations of ‘hipster’ businesses for home buyers looking to embrace indie culture, using the number of times the word ‘hipster’ is mentioned in each city’s Yelp reviews, and how many ‘hipster-type’ business per capita are in each city.

How to Rebuild a Healthy Home after a Disaster

Catastrophic events can destroy homes and cost millions of dollars in property damage.

If your Charlotte NC home has been damaged by a natural disaster — flood, fire, tornado or hurricanes -you’ll probably need to deal with repairs. There are lots of things to think about when you face the need to rebuild after a disaster.

The U.S. Department of Housing and Urban Development highlights putting people first when rebuilding damaged homes. They also remind the public to wait for proper authorities to give the go signal before returning to damaged properties.

 

Here are some tips on how to rebuild a healthy home after a disaster:

  • Always prioritize people over property. Your life and your family’s safety are far more important than whatever valuables you may own.

 

  • Don’t forget to wear personal protective equipment (PPE) such as safety helmets, gloves, eye protection, high-visibility clothing, safety bartwear and safety harnesses. Use a NIOSH-approved respirator when entering a damaged or moldy building.

 

  • Make sure to check for structural ability and hidden hazards before entering a damaged property. If possible, hire a professional home inspector to assess the structural damage to your home.

 

  • Make a plan which includes the supplies and methods you will use in rebuilding your damaged home. Create a map showing the disposal and clean-up site layout. Go over your insurance policies and disaster assistance resource and establish with your insurance agent what your policy does and does not cover.

 

  • If your home was built before 1978, assume lead-based paint and asbestos are in your property unless verified not present. Remember that disturbing such materials increases the hazard. Read this for more information on the hazards of homes built before 1978.

 

  • Go slow when pumping out water, then act fast to dry out and remove mold. Study and share the DIY Mold Removal Guidelines sheet from the Rebuild Healthy Homes guidebook.

 

  • Remove wet insulation and foam padding, even if the surface looks dry and clean. Discard all wet and moldy fibrous and open cell foam insulation.  

 

  • Control dust, capture debris and contain contaminants – with wet methods, drop cloths, debris bags, and workers trained in safe work practices.Keep children and pregnant women away from any area that might have lead dust or debris. If using power tools or sanders, a HEPA filter vacuum attachment is necessary.

 

  • Always check credentials and hire only licensed and insured contractors, Lead-Safe Certified Renovators, certified Asbestos professionals, Mold Remediation Contractors, Fire and Water Damage Restorers, and other professionals, depending on type of work needed. You may also check your state’s contractor licensing agency for lists of licensed or registered general and specialty contractors.

 

  • Restore for More than Before! If you do so, you will be rewarded with a stronger, safer, more resilient, durable, comfortable, convenient and healthy home. Install hazard-resistant materials, connectors and building systems. Make sure to include energy-saving and healthy home improvements.
